Trademark Prosecution

Trade mark prosecution or registration is the process of registering a trade mark for a product or service. Different countries have specific requirements for registration but the processes are broadly the same, involving conducting searches to ensure that mark is not overly similar to another previously registered mark, the filing of various forms and documents to establish the registrant’s right to exclusive use of the trade mark in question, responding to queries from the relevant trade marks registry arising from the examination of the mark and dealing with potential opposition proceedings.

In Singapore, trade mark prosecutions are conducted through the Intellectual Property Office of Singapore (“IPOS”). As Singapore is also a member country to the Madrid Protocol, international registrations can be effected in any of the 93 other member countries to the Madrid Union through IPOS.
